Terms of Service

1. Service description

HoodCleaningReport is a software-as-a-service tool that helps commercial kitchen exhaust cleaning contractors generate professional service reports. You upload photos, fill in a structured form, and receive a formatted PDF report.

The Service is a report generation tool only. We are not a compliance authority, inspection body, fire safety consultant, or legal advisor. We do not certify, verify, or guarantee that any report generated through the Service will satisfy the requirements of any Authority Having Jurisdiction (AHJ), fire marshal, insurance provider, or regulatory body.

2. User responsibilities

You are solely responsible for the accuracy, completeness, and truthfulness of all data, photos, measurements, and information you enter into the Service. You are responsible for ensuring your work and reports comply with applicable local, state, and federal regulations, including but not limited to NFPA 96 and ANSI/IKECA C10 standards.

You agree not to use the Service to generate fraudulent, misleading, or falsified reports.

3. Accounts

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate and current information during registration.

4. Plans and payment

The Service offers a free plan and paid subscription plans. Pricing, features, and plan details are listed on our Pricing page and may change with notice.

The free plan is available to individual operators at no cost and includes a monthly limit on the number of reports generated, as specified on the Pricing page. No credit card is required to use the free plan.

Paid subscription fees are billed monthly and are non-refundable except where required by applicable law. You may cancel a paid subscription at any time. Cancellation takes effect at the end of your current billing period, after which your account reverts to the free plan unless you choose to delete it.

Payment processing is handled by third-party payment processors. We do not store your credit card or bank details directly.

5. Intellectual property

You retain full ownership of the content you create using the Service, including your photos, report data, and generated PDF reports. By using the Service, you grant us a limited license to process and store your content solely for the purpose of providing the Service to you.

The Service itself, including its design, code, branding, templates, and documentation, is owned by Lead Catalyst Tech LLP and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

6. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that reports generated through the Service will meet the requirements of any specific AHJ, fire code, insurance policy, or regulatory standard. We do not warrant that the Service will be uninterrupted, error-free, or secure.

7. Limitation of liability

To the maximum extent permitted by applicable law, Lead Catalyst Tech LLP and its officers, directors, partners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of revenue, profits, or business
• Failed inspections, citations, fines, or regulatory penalties
• Fire damage, property damage, or personal injury
• Loss of data or service interruptions
• Any claims arising from reliance on reports generated through the Service

In no event shall our total liability to you exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.

You acknowledge that the Service is a formatting and report generation tool. The accuracy of any report depends entirely on the data you provide. We bear no responsibility for the quality of your cleaning work, the accuracy of your measurements, or the outcome of any inspection.

8. Indemnification

You agree to indemnify, defend, and hold harmless Lead Catalyst Tech LLP and its partners, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service, (b) any reports you generate, (c) your violation of these Terms, or (d) your violation of any applicable law or regulation.

9. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose
• Generate fraudulent or intentionally misleading reports
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or its infrastructure
• Resell, sublicense, or redistribute access to the Service without our written consent

10. Termination

We may suspend or terminate your account at any time if you violate these Terms or engage in conduct that we reasonably believe is harmful to the Service or other users. You may terminate your account at any time by canceling your subscription and contacting us.

Upon termination, your right to use the Service ceases immediately. We may delete your data in accordance with our Privacy Policy.

11. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised effective date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing law and dispute resolution

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in India.
